In these terms and conditions, “Client” means the purchaser of our services, and “Quotation” refers to an individual offer for a service emailed from ATG Translations to the Client, and includes all relevant information for the offer including price and delivery date.

By agreeing to a quotation provided by ATG Translations, the Client agrees to the following terms and conditions:

‍Quotations & Payment Terms
‍The Quotation will remain open for acceptance for 30 days from the date of quotation. Any changes of any kind to the agreement detailed in the Quotation must be agreed in writing with ATG Translations. ATG Translations may outsource or sub-contract all or any part of the agreed services to a third party and has no obligation to divulge any details of any such outsourcing to the Client.The Client shall pay the agreed fees via bank transfer or PayPal to ATG Translations, and the Client shall pay for any additional charges incurred by their bank or PayPal for making such payment. ATG Translations will begin work for the Client only after receipt of payment from the Client, unless agreed otherwise in writing by ATG Translations, or unless the Client is approved for a credit account by ATG Translations. Clients holding a credit account with ATG Translations shall make their payments immediately upon receipt of invoice. We reserve the right to charge interest on overdue accounts, such interest to be calculated daily on the amount outstanding at the rate of 4 per cent above the published base rate of Lloyds Bank plc.

‍Delivery
‍Any date specified by ATG Translations is given as an estimate only. ATG Translations will endeavour to achieve such an estimated date, but in the case of delayed delivery ATG Translations shall not be liable for any consequential direct or indirect damage or loss, and under no circumstances shall such delays amount to or be deemed a breech of contract, nor shall it entitle the Client to treat the contract as repudiated.Posting or despatch to a carrier (including post, fax, e-mail, or internet) for the purpose of transmission to the Client shall constitute delivery to the Client, and the risk shall pass to the Client.

Liability
‍ATG Translations shall not be liable in any circumstances whatsoever, to the Client or to any third party, for any consequential loss or damage of any kind whatsoever. The Client shall indemnify ATG Translations (including its employees, agents, and sub-contractors) against all claims and demands upon ATG Translations for any such consequential loss or damage of any kind. Under no circumstances whatsoever shall the Client demand from ATG Translations any compensation more than the amount paid for the service, and in order to raise such a claim, the Client must submit a full written report to ATG Translations detailing all alleged errors in the translation, which ATG Translations will then at its discretion either retype the work or compensate the Client at an amount that does not exceed the amount paid by the Client for that individual service. If such a report is not received by ATG Translations from the Client within 10 working days of delivery of the work to the Client, then the Client shall be obligated to pay ATG Translations in full for the service, and ATG Translations shall have no liability whatsoever regarding quality of the services provided, quality of the translation, or for failure to maintain the Quotation. 

‍Cancellation
‍The Client shall pay the full quoted price for the order and is not entitled to cancel the agreed upon services unless otherwise agreed with ATG Translations in writing, and if a cancellation is agreed upon, the Client shall compensate ATG Translations for the work carried out prior to notice of termination in addition to the cost of terminating the assignment and loss of revenue.

‍Confidentiality
‍Confidential documents and files made available to ATG Transactions are treated as strictly confidential and will not be disclosed to a third party without the approval of the Client, with the exception of ATG Translations’ employees or sub-contractors who require such disclosure to carry out their work, and except where ATG Translations is required by law to divulge such information. Confidential information does not include information that is or will be known to the general public or that in any other way (unrelated to the assignment) is received by ATG Translations.

‍Force Majeure
‍ATG Translations shall not be liable for any failure or delay in the performance of the agreed quotation (including but not limited to the failures by ATG Translations to comply with its obligations contained in this Agreement) by an event of force majeure, unforeseen circumstances beyond the control of ATG Translations, including but not limited to illness, fire, flood, natural disaster, acts of God, war, terrorist attack, riot, embargo, acts, decisions and regulations of civil or military authorities, accident, strike, limitation on transportation facilities or unavailability of fuel, power, labor or materials. 

‍Governing Law & Jurisdiction
‍This agreement is governed by and construed in accordance with United Kingdom law and is subject to the non-exclusive jurisdiction of the courts of the United Kingdom.
